The S.Ct. isn't an agency, it's in the judicial branch, but it acts very much like an agency because it expands its jurisdiction well beyond its authorization, to invade Congressional powers. The point of these agencies is to render elected officials superfluous. So we have permanent unelected Court justices and executive employees who run the government and amateur elected temps, to paraphrase Scalia in his comments at oral argument in the Town of Greece case. This is the colonial structure the founders thought they had defeated at Yorktown. Didn't happen.
