At the time Trump's personal fixer Michael Cohen was convicted of campaign finance violations directed by Donald Trump, Trump was the President of the United States. It is a Justice Department directive that a sitting President cannot be charged with a Federal crime. Therefore Trump was named an unindicted co -conspirator under the heading of Individual 1.

Now that Trump is no longer President, the DOJ can absolutely charge him with the same campaign finance violation that landed Michael Cohen in prison.
