Judge Tosses Criminal Charges Against James Comey and Letitia James

NY Times -  A federal judge threw out the criminal charges against James Comey, the former F.B.I. director, and Letitia James, New York’s attorney general, on Monday after finding that the prosecutor President Trump handpicked to bring the cases had been illegally appointed. A footnote in the Comey opinion underscores a tricky issue his defense lawyers might raise if the Trump administration were to attempt to file new charges even though the statute of limitations has expired. Although federal law says the government gets another six months to bring new charges if an indictment is dismissed for “any reason,” there are also court precedents that say if an indictment is invalid, it is a “nullity” that cannot be used to delay the expiration of the statute of limitations — at least for the purpose of later filing a superseding indictment.
