Emily Kwong, NPR - Birthright citizenship, ratified in the aftermath of the Civil War, has
been a cornerstone of American law since 1868. The 14th Amendment reversed the Dred Scott decision, which originally ruled that slaves had no standing before the high court to demand their freedom. Then, in 1898, the United States vs. Wong Kim Ark
further affirmed that birthright citizenship is conferred to all
individuals born within U.S. borders, regardless of their parents'
nationality or immigration status.
Now, Trump’s order challenges a century of law.
